In this case, the petitioner is seeking anticipatory bail in connection with NTPC P.S. Case No. 78 of 2019, registered for the offence under Sections 341, 323, 353, 504 of the Indian Penal Code.
Allegation has been made against the petitioner that when the Choukidar had gone to serve the notice upon him, he refused to take the same and assaulted the Choukidar. Learned counsel for the petitioner submits that the dispute arose on account of fact that the Choukidar had come to serve the notice upon the petitioner and demanded Rs. 1,000/- from him. When the petitioner refused to pay the same, the Choukidar, being a Police Personnel, tried to extract the money.

No.86070 of 2019(2) dt.18-02-2020 2/2 Looking to the fact that the petitioner has assaulted a public servant while he was discharging his official duty, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within four weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order on the same day without being influenced by the order of this Court.
