JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 17-05-2022 Heard learned counsel for the petitioner, learned counsel for the complainant and learned APP for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 420 and Section 138 of the N.I. Act.

The allegation against the petitioner is that the complainant Udakant Sah entered into an agreement with the petitioner for the purchase of one Scorpio vehicle for consideration money of Rs.1,70,000/- and for that the O.P. No.2 paid a sum of Rs.1,70,000/- .

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that petitioner issued a cheque of Rs.70,000/- in

Patna High Court CR. MISC. No.86235 of 2019(5) dt.17-05-2022 2/2 favour of the O.P. No.2 but the same dishonoured. A supplementary affidavit has been filed on behalf of petitioner which is kept on record stating that he is ready to pay Rs.70,000/- to the Opposite Party No.2 at the time of filing of the bail bond before the court below.

The learned counsel appearing on behalf of the complaint has also accepted the offer of the petitioner. Considering the aforestated facts, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-XIII, Bhagalpur in connection with Complaint Case No. 1111 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
