2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 80, 103(1), 115(2), 351(2), 351(3), 3(5) of the Bharatiya Nyaya Sanhita.
3. Informant suspects that all the F.I.R. named accused persons, including this petitioner, committed murder of the daughter of informant due to non-fulfillment of demand of dowry.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner
Patna High Court CR. MISC. No.1330 of 2026(6) dt.29-06-2026 2/3 is second wife of the husband of deceased and she is simply victim of over-implication. Allegation against petitioner is general and omnibus. As a matter of fact, the deceased was suffering from illness since long time and she died during course of treatment. It is further submits that thrust of accusation is against husband of the deceased who has already been granted regular bail by a co-ordinate Bench of this Court vide order dated 11.02.2026 passed in Cr. Misc. No. 79899 of 2025.
5. Learned A.P.P. for the State as well as learned counsel for the informant vehemently opposed the bail application.
6. Considering the nature of accusation and the fact that husband of the deceased has already been granted bail, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of her arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Katihar Nagar P. S. Case No. 758 of 2024, subject to condition as laid down under Section 482 (2) of
