The petitioner seeks bail in connection with Belsand P.S. Case No. 190 of 2018 registered for the offences punishable under Sections 302/34/120(B) of the Indian Penal Code and Section 27 of the Arms Act, 1959.
There is allegation in the F.I.R. that on 21.11.2018 at 6.30 A.M., one Rajendra Bhandari informed the informant that some miscreants has shot dead Tunna Baua on which the informant ran towards the Dera of Prem Chandra Bhandari and saw her husband was lying and pool of blood who told the informant that Divakar Kumar Singh, Laxmi Das and Vikash Mishra along with 2-3 others have fired upon him and fled away towards Madhkaul. Learned counsel for the petitioner submits that there is general and omnibus allegation against the petitioner. He further submits that similarly situated co-accused has been granted bail by a Co-ordinate Bench of this Court vide order dated 17.08.2019 passed in Cr. Misc. No.31151 of 2019. Learned counsel for the petitioner further submits that the petitioner is in jail custody since 11.12.2018.
In the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Sitamarhi in connection with Belsand P.S. Case No. 190 of 2018.
