This application for grant of regular bail arises out of Rail (Son Nagar) P.S. Case No. 37 of 2019 registered for the offence punishable under Sections 302 and 201/34 of the Indian Penal Code.

I have perused the case diary. It has been pointed out by learned counsel appearing on behalf of the petitioners that further two named co-accused persons, namely, Kundan Kumar and Deepak Kumar, have been allowed regular bail by this Court by orders dated 20.01.2020 and 25.02.2020 passed in Cr. Misc. Nos. 705 of 2020 and 295 of 2020. He has submitted that case of the petitioners is on similar footing, who are in custody since 03.10.2019.

No.624 of 2020(6) dt.22-06-2020 2/2 On perusal of the case diary, I find substance in submission made on behalf of the petitioners that the petitioners' case cannot be distinguished from the case of other two coaccused persons for the purpose of grant of regular bail. Considering the above, this application is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Railway Magistrate, Gaya, in Rail (Sone Nagar) P.S. Case No. 37 of 2019.
