2. The petitioner in this application prays for grant of regular bail in connection with Athmalgola P.S. Case no. 370 of 2025 registered for the offence punishable under sections 25(1-B) (a), 26 and 35 of the Arms Act.

3. As per the prosecution case, on secret information having been received and a raid being conducted. Various articles including two pistols, five live cartridges and 10 empty cartridges were recovered from the roof of the house of the petitioner. The petitioner as also his two sons were made accused.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. Neither any incriminating article has been recovered from the

Patna High Court CR. MISC. No.561 of 2026(2) dt.15-01-2026 2/2 petitioner's possession nor from his house. The petitioner has no criminal antecedent and is in custody since 8.10.2025. Chargesheet has been submitted in the case.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegation in the F.I.R., the petitioner having remained in custody since 8.10.2025, chargesheet having been submitted in the case and the petitioner having no criminal antecedent, it is directed that the petitioner above named, be released on bail in connection with Athmalgola P.S. Case no. 370 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Barh, Patna.
