JUSTICE SHIVAJI PANDEY ORAL ORDER 18-02-2020 Heard learned counsel for the petitioners, learned counsel for the State and learned counsel for the Informant. In this case, the petitioners are seeking anticipatory bail in connection with Mansi P.S. Case No.163 of 2019, registered for the offence punishable under Sections 341, 323, 379, 504, 384, 386 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation has been made that the petitioners have entered into the agricultural land and started cutting the standing trees. Looking to this, the informant opposed the same, whereafter altercation took place and the accused persons caused the injury to the informant, but from the order impugned,

Patna High Court CR. MISC. No.86226 of 2019(2) dt.18-02-2020 2/2 it appears that the present petitioners have purchased the land in the year 1996, whereas the informant has purchased the same land in the year 2015 and every person has a right to save his property.

Looking to the entire facts and circumstances of the case, let the petitioners, above-named, be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria in connection with Mansi P.S. Case No. 163 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
