JUSTICE SANDEEP KUMAR ORAL ORDER 18-07-2022 In this case, the petitioner is challenging the order dated 25.07.2019 passed by the Bihar Land Tribunal, Patna, in B.L.T. Case No. 626 of 2018, by which the order dated 17.11.2017 passed by the Sub-Divisional Officer, Banmankhi, in Appeal Case No. 11 of 2012-13 has been set aside and matter has been remitted back to him for deciding the matter afresh. It is an admitted position that the impugned order was passed without hearing the petitioner-respondent no.6 in B.L.T.

Patna High Court CWJC No.2987 of 2020(4) dt.18-07-2022 2/2 In view of the above, the order dated 25.07.2019 passed by the Bihar Land Tribunal, Patna, in B.L.T. Case No. 626 of 2018 is set aside. The matter is remanded to the Bihar Land Tribunal, Patna, for deciding the same afresh after giving notices to both the parties and after hearing them by a reasoned order.

With the aforesaid observations and directions, this writ petition is allowed.
