2. The present petition has been preferred for the grant of following relief(s):

"for issuance of the appropriate writ/writs/direction/directions/order/orders commanding the respondents to remove the illegal encroachment made by the Staterespondents and his contractor (Respondent no.

6) from the personal raiti Khatiani Land of the petitioner, whereupon, without consent of the

Patna High Court CWJC No.220 of 2026(3) dt.10-03-2026 2/3 petitioner, without giving notice and opportunity of being heard to the petitioner, and without making Land acquisition process, and without giving any amount of compensation to the petitioner. The respondents have made road, under the scheme of Hon'ble Chief Minister's village contact Scheme (Chief Minister's Rural connectivity Scheme) in the project of Road Construction from Khanejadpur Siwan, to Primary School, Mothaha Maul.

This encroachment has been made by the respondents over the 4-decimal of land of the petitioner bearing Khata no. 637, Khesra No.

-01, situated in Mauja-Jhapha, Thana no. 594, Anchal Minapur, P.S. Rampurhari, Dist. - Muzaffarpur."

3. After some arguments, learned counsel for the petitioner submits that it will suffice, if he is allowed to approach the respondent no.4, the District Magistrate-cumCollector, Muzaffarpur for the redressal of the grievance.

4. Learned State counsel has no objection.

5. Accepting the submissions put forward by the

Patna High Court CWJC No.220 of 2026(3) dt.10-03-2026 3/3 parties, the writ petition is disposed of allowing the petitioner to approach the respondent no.4, the District Magistrate-cumCollector, Muzaffarpur, who shall after putting the parties on notice/hearing them, will take the matter to its logical conclusion at an earliest.
