JUSTICE ASHUTOSH KUMAR ORAL ORDER 25-06-2020 Heard Mr. Manish Kumar No. 2, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Tekari P.S. Case No. 222 of 2019 dated 07.07.2019 instituted for the offences under Sections 409, 420, 467, 468 and 120(B) of the Indian Penal Code. An First Information Report was lodged on the basis of an information given by the Block Development Officer, Tekari, Gaya to the Officer-in-Charge of Tekari Police Station. Names of several persons were also included in the aforesaid report. The allegation, in sum and substance, is that there was bungling in the disbursement of Indira Awas

So far as the petitioner is concerned, he has not been named in the F.I.R. nor has he been named in the enquiry report. During the course of investigation, it appears that one Dheeraj Sharma became instrumental in getting the petitioner framed in the present case. Allegation against him is that after sale of paddy, he deposited the amount in the bank account of the Chairman of the concerned PACCS. It has been submitted on behalf of the petitioner that he is a farmer, who has sold his paddy to the PACCS. The allegations do not make out any sense and merely because some influential persons of the locality are having some axe to grind against the petitioner, he has been made accused in this case.
Regard being had to the vague nature of allegation against the petitioner, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds
