2. The petitioner in this writ petition filed under Article 226 of the Constitution of India has prayed for following reliefs:- "1. That This is an application for issuance of a Writ of Mandamus or any other Writ or Direction or Order, directing the concerned respondents District Magistrate and respective Police Officers to provide constant and ample safety and security to the petitioner who has got absolute right over the landed properties description of which are as under from all of Courts and proceeding over. Private respondent is influential land desperado of the area where the landed properties of the petitioner situated who have taken law and Order in their hands and are not abiding by the Order and Judgement, passed in favour of
Patna High Court CWJC No.2927 of 2020(4) dt.10-11-2025 2/3 the petitioner and adamant to do away their lives, if they ever visit and go to take care of the landed properties in question and hence this Writ Petition has been filed for safety and security of their lives land also over the landed properties in question for the following Reliefs:- (i) For giving a direction upon the concerned respondents to bind the private respondents from interfering in the peaceful possession of petitioner on their lands as given below.
(ii) For giving a direction to the concerned respondents to give adequate protection to the petitioner for the safety of their lives and properties from the private respondent as provided Under Seduction 22(1) land (2) of the Maintenance & Welfare of Parents and Senior Citizen Act, 2007 to which is Governing Rules 2012. It is obligatory duty of the concerned respondents to protect the lives and properties of the Senior Citizen of India in support of the Articles 21 and 300A of the Constitution of India. (iii) For a direction to the L.R.D.C., Patna (Respondent No.4) to fruitify the Orders/instruction, direction/directions to superseded the proceeding was completed and dropped in the year ended on 22.12.2015. Last effected Order before the Court of Divisional Commissioner, Patna. in this context pre-emption repealed
Patna High Court CWJC No.2927 of 2020(4) dt.10-11-2025 3/3 on Feb. 2019 hence after completion of proceeding since 2015 this is no effect of retrospective.
(iv) For any other relief/reliefs, the petitioner is entitled to vide-Mauza-Marchi, Thana No.22, P.S.-Bypass, Khata No.73 Survey Plot No.630, Area-2 Kathas."
3. Considering the nature of the issue raised by the petitioner as well as having gone through the averments made in this writ petition, the petitioner has not made out a case for invoking writ jurisdiction of this court. Accordingly, this Court finds no merit in this writ petition and the same stands dismissed.
