The petitioner seeks bail in connection with Darbhanga Sadar (Mabbi O.P.) P.S. Case No.111 of 2019 registered under Sections 328, 307, 379 and 34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that the petitioner is neither named in the FIR nor any recovery of incriminating article has been made from his possession. It is further contended that two other co-accused, namely, Pappu Kumar and Indal Sahani having identical allegation as against the petitioner have already been granted bail vide order dated 04.12.2019 and 18.12.2019 passed in

Patna High Court CR. MISC. No.86583 of 2019(3) dt.19-03-2020 2/2 Cr.Misc. No.77249 of 2019 and Cr.Misc. No.81868 of 2019 respectively.

Learned counsel for the State has opposed the prayer for grant of bail to the petitioner. However, he admits that the case of the petitioner is identical to that of other two coaccused, who have already been granted bail. In view of submissions made above, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Darbhanga Sadar (Mabbi O.P.) P.S. Case No.111 of 2019.
