Petitioner in the present case is seeking regular bail in connection with Rajauli P.S. Case No. 296 of 2019 registered for the offences punishable under Sections 30(A) and 41 of the Bihar Prohibition and Excise Act, 2016.

Although, learned counsel for the petitioner submits that the name of the petitioner has been brought in this case merely on the basis of the confessional statement of the coaccused who was arrested by police and alleged that he had taken the consignment of the illicit liquor from the petitioner and further submission has been made to the effect that the petitioner has been purposely involved in this case because he acts on behalf of the police, this Court having noticed the

Patna High Court CR. MISC. No.85905 of 2019(2) dt.18-01-2020 2/2 criminal antecedent of the petitioner in Paragraph '3' of the application for similar offence under the Bihar Prohibition and Excise Act and considering the period of custody in this case only since 27.11.2019, at this stage not inclined to grant regular bail to this petitioner.

The petitioner, may, however renew his prayer for bail after a reasonable period.
