====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-02-2020 Petitioner seeks regular bail in connection with Ladaniya P.S. Case No. 146 of 2019, G.R. No. 1545 of 2019, registered for the offence punishable under Sections 272, 273 and 414 of the Indian Penal Code and 30(a) of Bihar Prohibition & Excise Act, 2016.

As per FIR, allegation against the petitioner is that stolen motorcycle along with 150 litres of liquor was recovered from behind the house of the petitioner.

Submission of the learned counsel for the petitioner is that nothing has been recovered from the possession of the petitioner or from his house. He is in custody since 30.11.2019 having no criminal antecedent.

However, learned A.P.P. for the State vehemently opposed the prayer for bail of the petitioner on the ground that

Considering the submissions of both the parties and in view of the facts and circumstances, I am not inclined to grant regular bail at this stage. However, the petitioner shall be at liberty to renew his prayer for bail after framing of the charge. Accordingly, this application is disposed of. (Vinod Kumar Sinha, J) uma/- U T
