JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 21-01-2020 The Circle Officer, Yogapatti in the district of West Champaran has issued notices in February 2019 informing the petitioners that they have illegally occupied public land which was settled in favour of others in Settlement Case No. 07 of 1971-72. The said notices have been put to challenge in the present writ application filed in January 2020.

2. Learned counsel appearing on behalf of the petitioners has submitted that despite the fact that the petitioners have responded to the said notice by submitting their

Patna High Court CWJC No.1309 of 2020(2) dt.21-01-2020 2/2 explanations, no final decision has been taken by the Circle Officer so far.

3. The notices, which have been impugned, do not suffer from any legal infirmity. The petitioners have already responded to the notices by submitting their explanations before the Circle Officer. There is no interference required by this Court with the impugned notices, in that background.

4. This application is disposed of with the only observation that while taking a final decision, the Circle Officer will keep in mind the stand of the petitioners in their respective explanations submitted before him pursuant to the notices in question.
