JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 05-06-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Dhoraiya P.S. Case No.36 of 2018, registered for the offence punishable under Sections 302 and 201/34 of the Indian Penal Code and Section 27 of the Arms Act.

The wife of the victim is the informant. The dead body of the victim was found lying adjacent to a road. It was noticed that he has been shot dead. There are 17 persons named in the First Information Report, belonging to the same village, who, according to the informant, might have killed her husband because of pending dispute in respect of a piece of land. Learned counsel for the petitioner has submitted that there is no eyewitness to the occurrence and petitioner's name has been mentioned in the First Information Report

Patna High Court CR. MISC. No.1627 of 2020(3) dt.05-06-2020 2/2 merely on the basis of suspicion as one of the probable killers. He has submitted that no incriminating material has been collected by the police in course of investigation showing petitioner's complicity in commission of the offence. On perusal of the First Information Report and the case diary, I find substance in the submission made on behalf of the petitioner.

Considering the above, this application is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.-Ist Class, Banka, in Dhoraiya P.S. Case No. 36 of 2018.
