2.The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Patauna P.S. Case No. 39 of 2025 instituted for the offence under Sections 137(2), 96 and 3(5) of B.N.S. and Section 8 of POCSO Act.

3. The case of the prosecution, in short, is that the petitioner along with others has kidnapped the minor daughter of the informant.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has

During course of investigation, the victim was recovered and she has given her statement under Section 183 of B.NS.S. wherein she has stated that she was on talking terms with the petitioner. She was married with one Sunil Kumar. Sunil Kumar used to assault her. One day, she had come to her parental house and went with Raushan, the petitioner to his aunt's house. She was thereat for four days and from there, she went to Bhitha, lived there for ten days. One day, when she was standing alone at near Kathaila Chowk, she was apprehended by a lady police. It has further submitted that from perusal of the statement of the victim, it is clear that she is aged about 19 years and she had fled with the petitioner as she was being assaulted by her husband. Petitioner is having no criminal antecedent. 5.Learned APP appearing for the State has vehemently opposed the prayer of bail of the petitioner.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Patauna P.S. Case No. 39 of 2025, he will be
