The petitioner seeks regular bail in connection with Kanti PS case no. 627 of 2019 instituted for the offence punishable under Sections 25(1-b)a, 26, 35 of Arms Act. The allegation is regarding recovery of one countrymade pistol with two live cartridges.

The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case. It is further submitted that though the petitioner is having a bad criminal antecedent, however he is on bail in all the cases filed against him. The petitioner is said to be languishing in custody since 22.08.2019. The learned counsel for the petitioner has also submitted that the petitioner is ready and willing to abide

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner, I deem it fit and proper to direct for release of the abovenamed petitioner on regular bail, immediately upon completion of six months of custody i.e. w.e.f. 22.08.2019 and further, subject to such other conditions as may be deemed fit and proper to be imposed by the learned court of Sub-Divisional Judicial Magistrate, West Muzaffarpur in connection with Kanti PS case no. 627 of 2019. It is further directed that immediately upon release of the petitioner on bail, the petitioner shall mark his presence before the officer-in-charge of the concerned police station at 10.30 am on every Monday, starting from the day he is released on bail, and in case of failure to do so on two consecutive occasions, the present privilege of bail shall stand cancelled automatically and the petitioner shall be taken into custody forthwith.

With the aforesaid observations and directions, the present petition stands disposed off.
