The petitioner seeks bail in anticipation of his arrest in connection with Kurhani P. S. Case No. 74 of 2019 dated 14.02.2019, instituted for the offences under Sections 147, 148, 149, 341, 447, 323, 307, 324, 302, 188, 354 and 427 of the Indian Penal Code
Patna High Court CR. MISC. No.85757 of 2019(7) dt.02-11-2020 2/3 and Section 27 of the Arms Act, 1959.
The mother of the informant was brutally killed by several accused persons including the petitioner for having protested against loud voice coming out of microphone.
The learned counsel for the petitioner has submitted that persons with similar allegations have been granted anticipatory bail by different Benches of this Court.
This does not persuade this Court for granting anticipatory bail to the petitioner.
The prayer for anticipatory bail, regard being had to the nature of accusation against the petitioner, is rejected.
However, if the petitioner surrenders before the court below and seeks bail, the court below shall take into account that all other accused persons having similar allegation have been granted bail and shall pass orders in accordance with law, without being prejudiced
