JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-02-2020 Heard learned counsel for the petitioner as well as learned counsel for the informant and learned Additional Public Prosecutor for the State.

Petitioner apprehends his arrest in connection with Bettiah Town P.S. Case No. 131 of 2019 registered for the offences punishable under Sections 384 and 385 of the Indian Penal Code.

The accusation against the petitioner is that he made obstruction in construction started by the informant and demanded Rupees one lac from the informant but perusal of the first information report goes to show that there appears to be land dispute between the parties.

Moreover, petitioner does not have any criminal

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah at West Champaran in Bittah Town P.S. Case No. 131 of 2019 subject to condition as laid down under Section 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) N.K/- U T
