1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 126(2), 127(2), 308(3)(5), 352, 351(1) and 3(5) of the B.N.S.

The learned counsel for the petitioner submits that the petitioner has antecedent of two cases and the informant alleges that he works with Bajaj Finance Company and on 22.10.2025, he was going to Katihar, when on the way, he met the petitioner who also asked him to take him along to Katihar, since he has some work there. Further, while returning, the petitioner asked the informant to take him to the place where he had work. Accordingly, the informant took him as per his direction. Patna High Court CR. MISC. No.91061 of 2025(4) dt.11-05-2026 2/3 threatened at point of gun and demanded extortion of Rs.Five Lacs and thereafter snatched his mobile, credit card and took his mobile pin and looted him of Rs.2,09,000/-.

4. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that during the course of investigation, it transpired that petitioner and the informant had not gone to Katihar together and on the date of occurrence the tower location of the petitioner's mobile number was at Khushkibagh, P.S. Sadar, District- Purnea, it is thus submitted that petitioner was not even present at Katihar when the occurrence is alleged to have taken place. It is further submitted that the date of occurrence is 22.10.2025 and the FIR came to be instituted on 30.10.2025 i.e. after a delay of eight days without any plausible explanation. It is next submitted that if privilege of anticipatory bail is granted, the petitioner will not abscond rather will cooperate in the investigation to prove his innocence.

5. Learned A.P.P. opposes the anticipatory bail application.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his

No.91061 of 2025(4) dt.11-05-2026 3/3 furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending/successor Court in connection with Kasba P. S. Case No.331 of 2025, subject to the conditions laid down under Section 482(2) of the B.N.S.S., with a further condition that one of the bailors of the petitioner shall be his father namely, Badal Modi.

7. The application stands allowed.

8. However, it is made clear that in the event, if any application is filed by the Investigating Officer before the learned trial Court bringing to its notice that petitioner, despite giving assurance to this Court, is not cooperating in the investigation or is not presenting himself as and when required, the learned trial Court shall be at liberty to cancel the bail bonds of the petitioner after recording reasons.
