Mr.Madan Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 14-01-2020 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek regular bail in connection with Khaira P.S. Case No. 380 of 2019 for the offence registered under Sections 272 and 273 of the Indian Penal Code and Sections 30, 30(A), 38 and 41 of the Bihar Prohibition Excise Act, 2016.

The allegation is regarding recovery of 145 litres of illicit liquor from a tempo.

The learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case and they are having clean antecedents. It is further submitted that the petitioners are languishing in custody since 31.10.2019.

No.86198 of 2019(2) dt.14-01-2020 2/2 Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioners coupled with the fact that the petitioners are having clean antecedents, I deem it fit and proper to direct for release of the petitioners herein on regular bail. Accordingly, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned 2nd Additional Session Judge-cum-Special Judge, Excise, Saran at Chapra in connection with Khaira P.S.
