In this case, the petitioner is seeking regular bail in connection with Mahila P.S. Case No.32 of 2019 registered for the offence under sections 377, 376, 511 and 354(B) I.P.C. A serious allegation has been made to have committed sexual assault upon the victim lady, but the victim in her statement recorded under section 164 Cr.PC has stated about attempting to commit rape on her and when she raised alarm, the villagers came there and she could save her modesty.

Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner for the present and accordingly, his prayer for bail is rejected.
