2. The petitioner seeks bail in connection with Chewra P.S. Case No. 60/2025 registered for the offences punishable under Sections 115(2), 126(2), 103(1), 352 and 3(5) of B.N.S.

3. As per the prosecution case, petitioner and others are said to have killed the deceased.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. It is next submitted that no offence under Section 302 I.P.C. is made out against the petitioner and there is no mens rea established in the case. Learned counsel further submits that petitioner has clean antecedent and he is in custody

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner on the ground that during an argument, the accused persons including the petitioner pushed the deceased due to which he fell down and subsequently died.

6. Considering the facts and circumstances of the case, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. II, Sheikhpura concerned Court below in connection with Chewara P.S. Case No. 60/2025.
