2. The petitioner is in custody in a case registered for the offence punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 109(1), 352, 351(2) of the BNS.

3. As per allegation in the FIR, it is a case of assault and demand of extortion money from the informant and his family members by the petitioner and the co-accused persons.

4. The learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case as the whole allegation in the FIR is being manipulated and

No.2870 of 2026(2) dt.28-01-2026 2/2 the real scenario is that there is case and counter case between the parties for which Pipariya PS Case No. 29 of 2025 has been instituted at the behest of the petitioner's side and to save from this case, the petitioner has been implicated in the present case. Petitioner is in custody since 04.11.2025 and there is no independent eye witnesses of the alleged occurrence.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

On perusal of FIR and impugned order dated 09.12.2025, it appears that there is no independent eye witnesses of the alleged occurrence and there is case and counter case between the parties, so let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Miss Gazila Saveena, Judicial Magistrate, 1st Class, Lakhisarai/concerned Court in connection with Pipariya P.S. Case no.- 26 of 2025.
