The petitioner seeks bail in anticipation of his arrest in connection with Mahila P.S. Case No. 81/2019 dated 03.10.2019 instituted for the offences under Section 498A of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.

This case was sent to the mediation centre for effective settlement of dispute between the spouses. However, because of the Mediation Centre of Patna High Court not functioning due to Corona pandemic, this

Patna High Court CR. MISC. No.85724 of 2019(9) dt.06-07-2021 2/2 Court deems it appropriate to remand the matter to the court below with a direction to facilitate the process of mediation between the spouses.

The present order is being passed on the consent of the learned counsel for the parties. This petition is being disposed off with a direction that in the event of the petitioner surrendering before the court below within a period of eight weeks from today, he shall be released on provisional bail. Simultaneously, the opposite party no. 2 shall be noticed and on the appearance of the informant, the court will explore the possibilities of settlement and if the issues between the spouses are settled, the provisional bail of the petitioner shall be confirmed. The provisional bail of the petitioner shall also be confirmed in the event of the informant showing an unreasonable attitude during the deliberations. If the conduct of the petitioner is not good, that should also be taken into account before confirming the provisional bail of the petitioner. The petition stands disposed off.
