JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-02-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Motihari Town P.S. Case No. 484 of 2019 registered for the offences punishable under Sections 25(1-B), a,26,35 of the Arms Act.

The name of this petitioner came in this case in confessional statement of co-accused Sunil Kumar, who was caught on the spot with fire arms.However, the aforesaid apprehended Sunil Kumar did not disclose this fact that the petitioner was also carrying any fire arm or aware about the fire arms which has been kept by him. Petitioner does not have any criminal antecedent which is evident from perusal of Para-3 of

Patna High Court CR. MISC. No.610 of 2020(2) dt.20-02-2020 2/2 the petition.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran in Motihari Town P.S. Case No. 484 of 2019 subject to condition as laid down under Section 438(2) of the Cr.P.C.
