The petitioners seek bail in connection with Sahiyara P.S. Case No. 90 of 2019 registered under Sections 188, 272 and 273 of the Indian Penal Code and Section 30 and 30(a) of Bihar Prohibition and Excise Act-2016.

It is submitted by the learned counsel for the petitioners that on perusal of the FIR and the seizure list, it would be apparent that these petitioners were neither arrested on the spot nor any incriminating articles has been recovered from their possession, but merely on the basis of disclosure of their name by other co-accused, who were arrested on the spot, they

Patna High Court CR. MISC. No.86494 of 2019(3) dt.19-03-2020 2/2 have been made accused in the instant case. It is further contended that they are in custody since 28.11.2019 and on completion of investigation, charge-sheet has already been submitted.

Considering the submissions made above, the petitioners are directed to be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.D.J.-IIcum-Special Judge, Excise Act, Sitamarhi in connection with Sahiyara P.S. Case No. 90 of 2019.
