2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 61(2), 112, 307, 305(a) & 313 of the BNS and under Section 66 of the Information Technology Act.
3. The case of the prosecution, in short, is that unknown miscreants have lifted a bag from a train and a mobile of Realme company. While the lady whom these articles belong, tried to chase the accused persons, she was pushed near the gate of the running train due to which she fell down and sustained injuries.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.91705 of 2025(3) dt.18-02-2026 2/3 FIR was lodged against unknown miscreants. During course of investigation one Aman @ Amaniya was apprehended and he has given his confessional statement and he has named this petitioner in his confessional statement. Learned counsel for the petitioner has further submitted that nothing has been recovered from the possession of this petitioner. It has further been submitted that similarly situated co-accused Md. Filtar and Md. Sinku have been granted bail by this Court and by learned Coordinate Bench vide Cr. Misc. Nos. 71947 of 2025 and 71942 of 2025 respectively. The case of this petitioner stands on similar footing. Learned counsel for the petitioner has submitted that the petitioner is languishing in judicial custody since 28.04.2025.
5. Learned Additional Public Prosecutor for the State has vehemently opposed the bail and has submitted that the petitioner is having criminal antecedent of one case.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Session Trial No. 780 of 2025, arising out of Bhagalpur G.R.P.S. Case No. 79 of 2025 on furnishing bail bond of Rs.10,000/- (ten
