JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 18-06-2020 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners are apprehending arrest in connection with Bihra P.S. Case No. 179 of 2019 for offences under Sections 366A and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioners have no criminal antecedents.

Considering the fact that petitioner nos. 1 and 2 are ladies, this Court is inclined to grant bail to them. Let petitioner nos. 1 and 2, above-named, in the event of arrest or surrender

Patna High Court CR. MISC. No.4680 of 2020(3) dt.18-06-2020 2/2 within one month from today, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Bihra P.S. Case No. 179 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

So far as petitioner nos. 3, 4, 5 and 6, namely, Chandeshwari Paswan, Mrityunjaya Paswan, Mukesh Paswan and Ashish Paswan are concerned, this Court is not inclined to grant bail to them. The application for anticipatory on behalf of the aforesaid petitioners is rejected.

However, liberty is granted to petitioner nos. 3, 4, 5 and 6 to surrender before the court below and pray for regular. If the petitioners surrender and pray for regular bail, the same shall be considered and disposed of on its own merits on the same day without being prejudiced by the order of this Court in the present case.
