JUSTICE ASHUTOSH KUMAR ORAL ORDER 19-06-2020 Heard Mr. Ravi Shankar Sahay, learned counsel for the petitioners, Mr. Amrendra Kumar for the informant and Mr. Dinesh Singh, learned APP for the State.

The petitioners seek bail in anticipation of their arrest in connection with Phulwaria P.S. Case No. 149 of 2019 dated 30.10.2019 instituted for the offences under Sections 341, 323, 324, 325, 307, 504, 506, 379 and 34 of the Indian Penal Code.

It has been submitted on behalf of the petitioners that they have been attributed with general and

Patna High Court CR. MISC. No.86533 of 2019(3) dt.19-06-2020 2/2 omnibus allegation of assault. The injuries suffered by the victim are all simple in nature, except one which is opined to be grievous. With respect to that, the learned counsel for the petitioners submits that such injury report has been obtained from a private hospital.

It has also been submitted that petitioners no. 2 and 3 are students, whereas petitioner no. 5 is a female. Apart from this, Mr. Sahay submits that there has been a settlement of dispute between the parties.

However, Mr. Amrendra Kumar, learned counsel for the informant submits that he has no information with respect to such settlement.

Be that as it may, considering the nature of accusation and the arguments advanced on behalf of the petitioners, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Phulwaria P.S. Case No. 149 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.
