The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Jamo Bazar P.S. Case No.209 of 2019 registered for the offence punishable under sections 272, 273, 308 and 34 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per allegation in the F.I.R., 3.6 litres of IMFL is said to have been recovered from the kitchen of the petitioner. It is submitted by learned counsel for the petitioner that the allegations of recovery of illicit liquor is false and concocted and he has been falsely implicated in this case.

Patna High Court CR. MISC. No.961 of 2020(2) dt.26-02-2020 2/2 The application for bail has been opposed by learned APP for the State. He submits that there is an earlier case also pending against the petitioner under the Bihar Prohibition and Excise Act.

Having heard learned counsel for the parties and taking into consideration the antecedent of the petitioner under the Bihar Prohibition and Excise Act, the Court is not inclined to enlarge the petitioner on anticipatory bail and as such the application for anticipatory bail is rejected. The petitioner is directed to surrender in the Court below within four weeks.
