The petitioner seeks bail in anticipation of his arrest in connection with Chanpatia P.S. Case No. 321 of 2018 dated 21.07.2018 instituted for the offence under Section 394 of the Indian Penal Code.

The petitioner has not been named in the FIR and his name has transpired in the confession of coaccused Sonu Kumar. It has further been submitted that Sonu Kumar had named another accused person viz. Ashok Kumar Paswan, who has been granted anticipatory bail by a bench of this Court in Cr. Misc. No. 86577 of 2019.

Patna High Court CR. MISC. No.86579 of 2019(3) dt.19-06-2020 2/2 petitioner that in another case in which the petitioner was made accused and about which reference has been made in paragraph -3 of the bail petition, the petitioner has been granted anticipatory bail.

Considering the all these facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, Bettiah, West Champaran in connection with Chanpatia P.S. Case No. 321 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
