The petitioner seeks regular bail in connection with Kopa P.S. Case No. 190 of 2019, registered for the offence punishable under Sections 272, 273 of the Indian Penal Code read with Section 30(a) of the Bihar Excise Amendment Act, 2016.

The allegation is regarding recovery of 50 liters of illegal country made wine from a motorcycle, which was being driven by the petitioner.

The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case. It is submitted that the petitioner is having a clean antecedent

Patna High Court CR. MISC. No.5198 of 2020(2) dt.24-01-2020 2/2 and he is languishing in custody since 22.11.2019. Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner, coupled with the fact that the petitioner is having a clean antecedent, I deem it fit and proper to direct for release of the petitioner on regular bail. Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise, Saran at Chhapra in connection with Kopa P.S.Case No. 190 of 2019.
