The present petition has been filed for the following reliefs:- (i) for issuance of an appropriate writ/order/direction to quash the appointment of respondent no. 4 who has been appointed to the post of Part Time Sweeper (PTS) in Punjab National Bank, Jaynagar Branch, District -Madhubani, ignoring the

Patna High Court CWJC No.1801 of 2020(4) dt.21-09-2023 2/2 genuine claim of the petitioner who was already working on the same post in the same branch since 2011 to 2019; (ii) for issuance of an appropriate writ/order/direction in the nature of Mandamus, directing the respondent concerned to appoint the petitioner to the post of Part Time Sweeper (PTS) in the Punjab National Bank, Jaynagar Branch, District-Branch.

3. Learned Counsel has taken this Court to paragraph 16 and has submitted that the petitioner participated in two selection process and having been unsuccessful, has challenged the entire selection process.

4. He as such, submits that in the light of the case of Hon'ble Apex Court in Ashok Kumar & Anr. vs State of Bihar & Ors. reported in (2017) 4 SCC 357 having participated in exam and later challenging it after being unsuccessful is impermissible.

5. Be that as it may, since no one has appeared, the petition stands dismissed for non prosecution. (Rajiv Roy, J) Neha/- U
