====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-01-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Daudnagar P.S. Case No.205 of 2019 registered under Section 30(a) of the Bihar Excise Act.

The accusation is that on receiving the information about keeping the liquor by Sadhu Yadav in a hut in villageNima, the informant along with other police personnel reached there. On seeing the police vehicle, two persons fled away from there, where three motorcycles were also parked. On search of the hut, 17 cartoons, each containing 48 bottles of 180 ml. Indian Made Foreign Liquor, were recovered. Three motorcycles were also seized from there. On query, the

Patna High Court CR. MISC. No.87211 of 2019(2) dt.20-01-2020 2/2 informant came to know from the neighbours that Sadhu Yadav and this petitioner used to do the business of illicit liquor. Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the petitioner was not apprehended on the spot rather his name has been disclosed by his neighbours but the name of the neighbours has not been disclosed in the F.I.R. The petitioner is in custody since 03.12.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-VII-cum-Special Judge (Excise), Aurangabad, in connection with Daudnagar P.S. Case No.205 of 2019.
