====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-02-2020 Petitioner seeks regular bail in connection with Khagaria P.S. Case No. 589 of 2018, GR No. 2391 of 2018, registered for the offence punishable under Sections 393 and 34 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of Arms Act.

As per F.I.R., it appears that the petitioner along with other co-accused persons has hired a car and, on pointed pistol, taken away the car. It appears that the petitioner has moved for bail before this Court which was rejected vide order dated 25.02.2019 passed in Cr.Misc.No. 75431 of 2018 with an observation to conclude the trial at the earliest preferably within a period of 9 months.

Submission of the learned counsel for the petitioner is that 9 months has already expired and there is no substantive

Patna High Court CR. MISC. No.929 of 2020(3) dt.24-02-2020 2/2 progress in the Trial. The petitioner is in custody since 31.08.2019 having no criminal antecedent.

Heard learned A.P.P. for the State and perused the report from which it appears that till now only two witnesses have been examined in this case.

Having heard both the parties and in view of the submissions made above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Mr. S.N. Tripathi, Judicial Magistrate, 1st Class, Khagaria, in connection with Khagaria P.S. Case No. 589 of 2018, GR No. 2391 of 2018 subject to the condition that he shall extend full cooperation in early conclusion of the Trial and shall present before the court below as and when required otherwise his bail bonds shall be cancelled and further observation that, before releasing on bail, the address of both the petitioner as well as the bailor must be verified.
