====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 24-03-2026 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State.

2. The petitioner seeks bail in connection with Chausa P.S. Case No. 211 of 2025 registered for the offence under Section 109(1) of the BNS and under Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner and others are said to have hatched conspiracy for killing the husband of the informant and thereafter they fired at the husband of the informant but he survived.

4. The petitioner is in custody since 7.8.2025 and it has been submitted by the learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in

He further submits that there is delay of about 8 days in lodging the FIR and the prosecution is not able the explain the same. He further submits that the petitioner was not present at the place of occurrence and there is land dispute between the parties. He also submits that some of the co-accused have already been granted bail by a coordinate Bench of this Court vide order dated 15.01.2026 passed in Cr. Misc. No. 1006 of 2026.

5. Learned counsel for the informant has vehemently opposed the application of the petitioner.

6. Considering the facts of the case, the delay in lodging the FIR and also considering the period of custody of the petitioner, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Udakishunganj, Madhepura/concerned Court below in connection with Chausa P.S. Case No. 211 of 2025.
