JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-02-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Triveniganj P.S. Case No. 253 of 2018 (G.R. No. 1329 of 2018), registered for the offence punishable under Sections 341, 323, 353, 332, 458 and 506/34 of the Indian Penal Code. The petitioner and one person having entered into hospital abused and assaulted the Doctor and other officials. However, it is submitted on behalf of the petitioner that petitioner worked in pulse polio scheme but his payment was not made and when he contacted the Informant for release of his

It has further been submitted that after three days when the Informant realized his fault he entered into compromise which has been annexed to this petition as Annexure-3 series.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner does not have any criminal antecedent which is evident from perusal of para 3 of the petition, this anticipatory bail is allowed and it is ordered that petitioner, above named, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Triveniganj P.S. Case No. 253 of 2018 (G.R. No. 1329 of 2018), subject to conditions as laid down under Section 438 (2) of the Cr.P.C.
