Mr.Bishweshwar Ram ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 16-01-2020 Heard the learned counsel for the petitioners and the learned APP for the State.

The petitioners seek regular bail in connection with Excise Case No. 815 of 2019 arising out of Bhagwanpur P.S. Case No. 204 of 2019 for the offence punishable under Section 30(A) of Bihar Prohibition and Excise (Amendment) Act, 2018. The allegation is regarding recovery of 30 liters of illicit liquor from the petitioners.

The learned counsel for the petitioners has submitted that the petitioners have been falsely implicated in the present case and is having a clean antecedent. Lastly, it is submitted that the petitioners are languishing in custody since 07.11.2019.

No.86754 of 2019(2) dt.16-01-2020 2/2 Having regard to the facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioners coupled with the fact that the petitioners are having a clean antecedent, I deem it fit and proper to direct for release of the petitioners on regular bail. Accordingly, the petitioners, above named, are directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Kaimur at Bhabua/ ADJ III cum Spl. Judge (Excise) Act, Kaimur at Bbabua in connection with Excise Case No. 815 of 2019 arising out of Bhagwanpur P.S. Case No. 204 of 2019.
