JUSTICE ASHUTOSH KUMAR ORAL ORDER 22-06-2020 The petitioner, who is the husband of the deceased, seeks bail in anticipation of his arrest in connection with Sonbersa P. S. Case No. 222 of 2019 dated 22.09.2019 instituted for the offences under Sections 304 (B) and 34 of the Indian Penal Code.

It appears from the F.I.R. that the informant was told by somebody that the deceased has been electrocuted. However, the relationship between the spouses was far from cordial. The post-mortem report discloses that the deceased died of sudden cardiac arrest.

However, considering the fact that the mother-inlaw of the deceased has been refused anticipatory bail by a

Patna High Court CR. MISC. No.86849 of 2019(3) dt.22-06-2020 2/2 Bench of this Court as has been informed by the learned counsel for the informant, Mr. Ajay Kumar Tiwary, I am not inclined to grant anticipatory bail to the petitioner. The prayer for anticipatory bail is rejected. However, if the petitioner surrenders before the court below and seeks bail, it shall be considered on its own merit, without being prejudiced with the fact that the present petition has not been entertained by this Court.
