Learned Counsel for the petitioners submits that by the impugned order, the learned Sub Judge-I, Arwal, has awarded Rs. 5,000/- against the petitioners as cost in Title Suit No. 56 of 2017 filed by the respondent-plaintiff for declaration of title.

From perusal of the impugned order, it appears that the learned Court below has exercised its discretion and has

Patna High Court C.Misc. No.128 of 2020(4) dt.11-07-2022 2/2 awarded cost against the petitioners. In my opinion, this Court may not go into the question of discretion exercised by the learned Court below in awarding the cost.

Accordingly, I do not find any merit in this application.

This application is, accordingly, dismissed.
