JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2020 The petitioner seeks regular bail in connection with Azamnagar P.S. Case No. 284 of 2019, registered for offences punishable under Section 354 (B) of the Indian Penal Code and 8 of POCSO Act.

Allegation against the petitioner and one co-accused is of attempt to commit rape on the daughter of informant. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and the real fact is that the she goat of the informant was grazing the field of petitioner, on which, he chided the daughter of informant and, thereafter, a dispute arose between the parties and due to which, the informant came out with this false case. Further submission is that co-accused Chandra Shekhar Sharma having similar allegation has already been enlarged on bail by a coordinate

Patna High Court CR. MISC. No.7271 of 2020(3) dt.28-02-2020 2/2 Bench of this Court vide order dated 18.01.2020 passed in Cr. Misc. No. 2983 of 2020 and petitioner has been languishing in judicial custody since 31.10.2019.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. -I-cum- Special Judge, Katihar, in connection with Azamnagar P.S. Case No. 284 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
