This writ application has been filed for the following reliefs:- (i) for issuance of direction upon the respondents for fixation and payment of pension and post-retirement benefits to the petitioner who retired as an Assistant on 31.01.2015 from S.S.V. College Kahalgoan under T.M.B. University, Bhagalpur; however the petitioner has been made to retire in the scale of Rs. 3,500/- corresponding to IVth grade without considering the facts that the petitioner initially appointed as Assistant Modification was also made to this extent and some documents are showing the petitioner was working as Typist vide letter dated 31.01.2015;

(ii) also prays for quashing the Letter No. 1744 dated 26.7.2016;

(iii) for payment of arrears of difference amount

Patna High Court CWJC No.2910 of 2020(9) dt.16-05-2023 2/2 arising out of such fixation toward pension and post retirement benefits to the petitioner including consequential benefits; (iv) for payment of admitted due towards previous and post-retirement benefits;

(v) for payment of statutory interest upon the dues amount arising out of such pension and post-retirement benefit from the date of same fell due.

With the consent of parties, the matter is being disposed of with a direction to the respondent no. 6, the Registrar Tilka Manjhi University, Bhagalpur to take a decision on the fresh representation to be filed by the petitioner within three months from the date of such filing.

It goes without saying that in between all the admissible dues will be paid to the petitioner and further after the disposal of the representation, if the respondent no. 6 comes to a positive conclusion, the follow up measure will be taken immediately in the next four weeks.
