JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-01-2020 This application, for grant of anticipatory bail, arises out of Pakaridayal P.S. Case No. 284 of 2019, disclosing offences under Sections 147, 149, 341, 323, 324, of the Indian Penal Code.
Allegation against the petitioner is of assault to the brother of informant by means of axe causing injury to him. Submission of learned counsel for the petitioner is that earlier his father was killed and informant and others are accused in that case and only to save his skin, the informant has come out with this false case and no occurrence in the manner as alleged by the informant has ever taken place and although, there is allegation of assault against the petitioner, injury sustained by the injured from the assault by the petitioner was found simple in nature.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -V, Motihari, East Champaran, in connection with Pakaridayal P.S. Case No. 284 of 2019, subject to the condition laid down under Section 438
(2) of the Code of Criminal Procedure.
