JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-03-2020 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in custody since 23.09.2019 and seeks bail in connection with Thawe P. S. Case No.135 of 2019 registered for the offences punishable under Sections 363, 366A of the I.P.C.

Both the victims have already returned to their home safely. The statements of victims were recorded under Section 164 of the Cr.P.C. The victims made contradictory statements. One victim, namely, Punam Kumari claimed that she as well as her sister were kidnapped by one Shahdeo and three unknown persons and subsequently, she was pushed from car whereas the culprits took her sister. No.86221 of 2019(3) dt.19-03-2020 2/2 Kumari does not state about the story of kidnapping rather she claimed that due to nervousness she left her home, but subsequently, she requested the petitioner to take her to home and while she along with petitioner was returning to her home, she as well as petitioner were caught by the police. The case diary goes to show that petitioner and victim Amrita Kumari were in love and the victim Amrita Kumari in her statement recorded under Section 161 of the Cr.P.C. admitted that she had left her home by her own volition. Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Thawe P.
