Petitioner is apprehending his arrest in connection with Manjhagarh P.S. Case No. 211 of 2019 for the offences under Sections 420, 409/34 of the Indian Penal Code. The present FIR has been lodged on the basis of letter No. 958 dated 12th August, 2019 of BDO Majha Gopalganj with allegation that the petitioner along with other persons being the secretary of the Managing Committee withdrew money of Mukhyamantri Gramin Pey Jal Nischay Yojana and Mukhyamantri Gramin Gali-Nali Pakkikaran Nischay Yojana. In this respect the status report was called for from the District Magistrate, Gopalganj . The District Magistrate, Gopalganj vide letter No. 1372 dated 23.3.2020 after annexing the letter No. 35
Patna High Court CR. MISC. No.85741 of 2019(3) dt.06-12-2021 2/3 dated 21.3.2020 of Deputy Collector cum District Public Grievance Redressal Officer, Gopalganj was received. The Deputy Collector, District Public Grievance Redressal Officer, Gopalganj has submitted in his report that 85% of work of these schemes have been completed and the water supply is also functional. The reason for non-completion of the work has been given in that report is, due to non-payment of the entire amount allocated for that work only 7,70,000/- against allocated amount 11,09,800/- was received.
Learned counsel for the petitioner has also submitted that co-accused Vinod Kumar has been granted anticipatory bail by learned coordinate Bench of this Court in Cr. Misc No. 5030 of 2020.
Considering the report that 85% work has been completed and water supply is also functional as well as the reason for non-completion of the work as per report is nonavailability of the entire fund, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
