Petitioners are apprehending their arrest in connection with Pupri P.S.Case no.394 of 2019 , registered for offences punishable under Sections 272, 273 and 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Petitioners are named in the FIR , however, the FIR shows that the recovery is from one co-accused and it is said that the petitioners were present there and they are in liquor trade and succeeded in fleeing away.
Submission of the learned counsel for the petitioners is
Patna High Court CR. MISC. No.657 of 2020(2) dt.23-01-2020 2/2 that except the confessional statement of the co-accused there is nothing against them and they are having no criminal antecedent.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ADJ-II, Sitamarhi in connection with Pupri P.S.Case No.394 of 2019 district Sitamarhi subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
