2.The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Kako P.S. Case No.304 of 2024 instituted for the offence under Sections 191(2), 191(3), 190 and 103(1) of B.N.S.

3. The case of the prosecution is that the petitioners along with other 7-8 persons in number have assaulted badly one Rahul Kumar. Rahul Kumar was referred to Patna for better treatment and in course of treatment he died.

4. Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.263 of 2026(2) dt.09-02-2026 2/3 petitioners has submitted that petitioners are innocent and have committed no offence. They have falsely been implicated in this case. The occurrence has taken place only due to misconception. The accused persons thought that the deceased had dragged the injured person whom he was actually trying to save. It has further been submitted that there is also a counter version of this case. The nature of allegation is general and omnibus. There is no specific allegation against any of the accused persons. It has also been submitted that similarly situated co-accused, namely, Rohit Kumar has been granted anticipatory bail by learned Coordinate Bench vide Cr. Misc. No. 68688 of 2025. The case of these petitioners stands on similar footing. They are having no criminal antecedent.

5. Learned APP appearing for the State has vehemently opposed the prayer of bail of the petitioners.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Kako P.S. Case No.304 of 2024, they will be enlarged on bail on furnishing bail bond of Rs.

Patna High Court CR. MISC. No.263 of 2026(2) dt.09-02-2026 3/3 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Jehanabad, subject to the conditions as laid down under section 482 (2) of the B.N.S.S.
