The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 30(a) (41(1) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner rather 15 bottles of 375ml each and 3 bottles of 750ml each total 7.875 litres of foreign liquor has been recovered from the house of co-accused Narayan Yadav. He submits that the name of the petitioner has come in the present case on the confessional statement of co-accused Narayan Yadav. He submits that there is no recovery from the house of the petitioner. He further submits

In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-2nd-cum-Special Judge, Excise, Darbhanga in connection with G.O. Case No. 899 of 2019 arising out of Ashok Paper Mill Police Station Case No. 129 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
